Terms of Service

By accessing or using BxScribe ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

BxScribe provides AI-assisted clinical documentation tools for Applied Behavior Analysis (ABA) professionals, including session note generation, client management, treatment plans and assessments, a family portal, fieldwork tracking, study tools and team collaboration features.

You must provide accurate information when creating an account. You are responsible for keeping your credentials secure, for turning on two-factor sign-in where your organization requires it, and for signing out on shared devices. You must notify us immediately of any unauthorized access to your account.

If you enter information about the people you serve, you are responsible for having the right to do so and for using the Service in line with the laws that apply to you, including HIPAA and state privacy and record-keeping laws. In particular, you agree to:

• Enter only the client information needed for care, documentation and billing
• Give team members the least access their work requires, and remove people who leave
• Keep clinical records for as long as your state and payers require — exporting them before you delete an account or a client if you need to keep them
• Not put client information in support tickets, feedback or contact messages — describe the problem instead

We process client information on your behalf and only to provide the Service, as described in our Privacy Policy. We don't offer a Business Associate Agreement yet; once we sign one with you, it governs our handling of your protected health information and controls over these terms where they conflict.

You agree not to:

• Use the Service for any unlawful purpose
• Access records you aren't authorized to see, or share your account
• Attempt to reverse-engineer, decompile, or extract the AI models or algorithms
• Resell, sublicense, or redistribute the Service without written permission
• Exceed reasonable usage limits or attempt to circumvent plan restrictions

AI features send the information they need to our AI provider, OpenAI, to produce a result: note drafting sends the session details you enter with the client's first name and relevant profile fields, dictation and live sessions send audio for transcription, and document tools send the document's text. OpenAI's API data policy applies; see our sub-processors page.

Everything the AI produces is a draft. You are responsible for reviewing, editing and approving it before it becomes part of a clinical record. BxScribe does not guarantee the clinical accuracy of AI-generated content, and the clinician of record remains responsible for all documentation submitted to payers or included in client records.

The Free plan includes a limited number of notes and clients each month. Individual and Pro plans are priced per account by clinician role (RBT, or BCaBA/BCBA) and billed monthly or annually. Agency plans are billed per seat. Study plans are one-time purchases that give access for a fixed period. Current limits and prices are on our pricing page and are shown before you buy.

Subscriptions renew automatically. You may cancel at any time from your billing settings — access continues through the end of the current billing period. Refunds are handled on a case-by-case basis.

You retain ownership of all content you create using BxScribe, including session notes, client records and study materials. Records created in an agency workspace belong to that agency. We do not claim ownership of your data.

You can export your data at any time: your account data from Settings, and — for agency owners, admins and compliance staff, or the clinician who owns a personal-workspace client — a client's full record from the client's page.

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Deletion takes effect after a 30-day grace period and removes your sign-in and personal workspace; records you created for an agency stay with that agency, and an agency's own records are deleted only when its owner closes it. Audit records are kept for seven years. The details are in our Privacy Policy.

BxScribe is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

We may update these terms from time to time. We will notify you of material changes via email or in-app notification, and may ask you to accept the updated terms before you continue using the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
